April 22, 2010 New Lead Law Is In Effect And Is Enforceable! |

The new RRP lead law is now in effect and has been enforceable since April 22, 2010. It is officially known as the Lead: Renovation, Repair and Painting Program. This new Federal regulation was enacted to protect children and adults during renovation, painting and repair projects in homes as well as child occupied facilities built before 1978. Children under the age of 6 have a higher risk of lead poisoning from lead dust and lead paint chips, thus causing an array of permanent health problems.

As a property owner or homeowner, the responsibility falls on your shoulders to protect the safety of your family, tenants or children. Property comes in all sizes- apartments, condominiums, duplexes, single family, etc. They can be private, or public housing or government assisted. What Contractors Should Know
After April 22, 2010, federal law requires that you are certified and use lead safe work practices. The new law requires contractors and maintenance professionals who disturb lead based paint in homes, child care facilities, and school built before 1978 to be certified in new procedures for proper lead removal.
They must follow lead safe practices when repairing, renovating or engage in painting activities that disturb more than six square feet of lead-based paint in a room, or when 20 square feet of lead based paint is disturbed on the exterior. This work covers a 30 day time period to complete the work. So if 4 square feet is worked on for 10 day, and then another 4 square feet are worked on 10 days later, this work falls within the 30 day time period and would fall under the rules of the law.
Contractors /renovators will be required to first provide a copy of the EPA’s pamphlet titled, “What you Need to Know About Lead Poisoning” followed by post warning signs, prevent dust and debris from spreading, restrict any occupants from the work areas, conduct a complete and thorough cleanup, and verify that the cleanup was effective.
*Homes built before 1940 most likely have a 87% chance of containing lead paint
*Homes built from 1940 to 1960 have a 69% chance of containing lead paint
*Homes built 1960 to 1978 have a 24% chance of containing lead paint
