After a company is trained and has taken all the steps to become certified for the new 2010 lead law, there are some additional precautions contractors may want to take. Compliance with new law is half of the battle, but also directly protecting yourself from claims doesn't hurt either. It's suggested that a contractor take the steps needed to protect himself.
Here are some helpful tips I found from a litigation attorney;
*A contractor may want to insert clauses into their contracts with homeowners, that address the the new lead law.
*The homeowner should confirm to you that he has seen your certification and that he has received a copy of the contract and appropriate lead law information.
*Also, make sure to ask if there are any pregnant women on the property or any children under 6 years old. Ask if any children in the house have tested with high levels of lead.
*General contractors may want to have clauses to ensure their subs would be the ones paying for their defense, should any claims be made due to their work on a project.
